1. Acceptance
By enrolling in or using Annoying-Is-Caring (the "Service"), provided by ShedInnovations LLC, you agree to these Terms of Service. If you don't agree, please don't use the Service.
2. The Service
The Service generates and delivers personalised humour content — jokes, cartoons, voice messages — to recipients designated by a paying subscriber (the "Carer"). The Carer is responsible for ensuring the recipient (the "Cared-for") consents to receive such content.
3. Acceptable use
You may not use the Service to harass, defame, threaten, or impersonate any person, or to generate content depicting minors, sexual content, hate speech, or content that violates applicable law. We reserve the right to refuse or remove generated content, suspend accounts, and cooperate with law enforcement where required.
Vulnerable cared-for persons. If, during the cared-for's opt-in flow (/i-am-in) or at any later point, the cared-for self-declares — or the carer discloses — a mental-health condition or other vulnerability that makes humour content potentially inappropriate or harmful, AIC reserves the right to decline activation of the subscription, or to suspend an active subscription. In such cases no billing is incurred: any pending payment authorisation is voided before the subscription becomes active, and an active subscription is cancelled with a pro-rated refund for the unused portion of the current period. The carer will be notified of the decision and may contact support if they believe it was made in error.
4. Subscription and trial
The 30-day free trial does not require a credit card and provides limited usage (3 image jokes, 1 video joke, no cartoon builder access). Paid subscriptions auto-renew monthly until cancelled. You may cancel anytime from the carer dashboard; access continues through the end of the paid period.
Video joke credits. When a video joke is explicitly requested but the underlying AI providers cannot produce it — for example because the prompt or attached media triggers their copyright, safety, or moderation filters, or because the providers are temporarily unavailable — we do not count it as a used video joke credit. In such cases AIC reserves the right to fall back to an image joke (consuming an image credit instead, where one is available) so that the carer is not left empty-handed. Fallbacks and refunds are decided by the platform, not by individual support tickets.
5. Privacy
We collect the carer and cared-for emails, content preferences, and any reference photos uploaded for face-image personalisation. Data is used solely to operate the Service and is not sold to third parties.

6. Intellectual property
The Service uses patent-pending technology owned by ShedInnovations LLC. Content generated for you is yours to share, but the underlying models, prompts, and generation infrastructure are not licensed or transferred.
7. Disclaimer
The Service is provided "as is." Generated humour is automated and may occasionally miss the mark. We are not liable for hurt feelings, eye-rolls, or sustained groans induced by particularly bad puns.

Privacy Notice
Effective May 2026. ShedInnovations LLC ("we," "us") operates Annoying Is Caring (the "Service"). This notice explains what personal data we process, why, and what choices you have. It supplements the Terms of Service above.
P1. Who we are
ShedInnovations LLC, dba Annoying Is Caring. Contact: support@annoying-is-caring.com. Acting as data controller for personal data described below.
P2. What we collect
- Account & subscription data — carer email, carer name, password (hashed PBKDF2-SHA256), Stripe customer ID and subscription ID, plan tier, payment status timestamps. Provided by the carer at sign-up.
- Cared-for data — cared-for email, name (optional), humour-category preference, optional reference photos for face-image personalisation, optional health-concern note (entered by the cared-for at opt-in), opt-in/opt-out timestamps. Provided by either the carer (initial enrollment) or the cared-for (during /i-am-in opt-in).
- Usage data — joke history (text, generated images and videos, voice clips), feedback (👍/👎 + comments), interaction timestamps, in-app crash reports, mobile device tokens for push notifications.
- Technical data — IP address, user-agent, referer URL, browser language, app version. Logged for ~30 days for fraud and abuse detection.
- Audit logs — investor portal sign-ins, admin-action timestamps, billing events. Retained 1 year.
P3. Why we collect it (legal bases)
- Contract performance — to deliver the Service the carer subscribed to (joke generation, delivery, billing).
- Legitimate interest — to operate the Service safely (fraud prevention, abuse detection, system reliability), improve it (aggregated analytics on humour-category effectiveness), and inform carers/cared-fors of subscription state changes.
- Consent — face-image personalisation requires uploaded photos (explicit upload action by the carer) and the cared-for must affirmatively click "I AM IN" before any joke is delivered to them.
- Legal obligation — to comply with applicable tax, accounting, and law-enforcement requirements.
P4. Third-party processors
We share personal data with the following service providers, only to the extent needed for them to deliver their function. Each operates under a data-processing agreement.
- Stripe, Inc. — payments, subscription billing. Receives carer email, payment instrument tokens, and metadata required to bill the subscription.
- OpenAI — joke text generation, content moderation, vision-based face-image safety checks. Receives joke prompts and reference photos transiently; OpenAI does not train its models on our API traffic per the OpenAI Data Privacy Addendum.
- Google (Vertex AI / Gemini / Veo) — joke image and video generation. Receives joke prompts and reference images transiently for the duration of a generation request.
- ElevenLabs — voice cloning and text-to-speech for audio jokes and cartoon builder. Receives audio samples (when the carer uploads a voice profile) and TTS prompts.
- FAL.ai / Hailuo / Luma / Pixverse / MiniMax — alternative video and image-generation pipelines used as fallbacks.
- Amazon Web Services — hosting (Lambda, S3, DynamoDB), email delivery (SES), CDN (CloudFront), in the us-east-1 region.
- Meta (Facebook / Instagram Graph API) — used only when AIC posts marketing content to its own social channels; no personal data of carers or cared-fors is shared with Meta.
We do not sell or rent personal data to advertisers, data brokers, or other third parties.
P5. International data transfers
The Service is hosted in the United States (AWS us-east-1). If you access AIC from outside the US, your data is transferred to the US for processing. For carers in the EEA / UK / Switzerland, we rely on Standard Contractual Clauses for any cross-border transfer as required by GDPR / UK GDPR / FADP.
P6. Retention
- Active subscription data — kept while the subscription is active.
- Joke history & reference photos — kept while the subscription is active. Deleted within 30 days of cancellation, except for items that need to be retained for billing or legal compliance (kept up to 7 years).
- Audit logs — 1 year.
- Technical/server logs — 30 days.
- Stripe billing records — held by Stripe per their retention policy (typically 7 years for tax reasons), independent of our retention.
P7. Security
Personal data is encrypted in transit (TLS 1.2+) and at rest (AWS-managed KMS keys for S3 and DynamoDB). Carer passwords are stored as PBKDF2-SHA256 hashes (200,000 iterations, 16-byte random salt). Access to production systems is limited to a small number of authorised personnel with multi-factor authentication. We undertake periodic security reviews and engage external penetration testing on the schedule appropriate for the Service's risk level.
P8. Your rights
Depending on your jurisdiction, you may have the right to:
- Access — request a copy of personal data we hold about you.
- Rectification — correct inaccurate data.
- Erasure ("right to be forgotten") — ask us to delete your data; we will honour the request unless we have a legal obligation to retain it (billing records, ongoing legal claims).
- Portability — receive your data in a machine-readable format.
- Objection & restriction — object to or restrict processing based on legitimate interest.
- Withdraw consent — for processing based on consent (face-image personalisation, opt-in to receive jokes), withdraw via the dashboard or by emailing support.
- Lodge a complaint — with your local data-protection authority (EEA: your national DPA; UK: ICO; California: AG / CPPA).
To exercise these rights, email support@annoying-is-caring.com from the email address on the account. We respond within 30 days.
P9. Children's privacy
AIC is not directed to children under 18. We do not knowingly enrol minors. If you believe a minor is using the Service, contact us and we will delete the data and terminate the subscription.
P10. Cared-for-specific protections
The cared-for is the recipient of jokes, not the paying customer. We require explicit opt-in (via /i-am-in) before any joke is delivered. The cared-for may opt out at any time (via /i-am-out, the unsubscribe link in any email, or by contacting support); the carer is notified, billing is cancelled at the end of the period, and the cared-for's reference photos are deleted within 30 days. The cared-for can also self-flag a health-concern at opt-in, which pauses auto-joke generation.
P11. Cookies and similar technologies
The marketing site (myjokes.ai/website) uses no third-party tracking cookies. We use a single first-party "preference" cookie to remember the carer dashboard session token (30-day expiry). The mobile app uses Firebase Cloud Messaging for push notifications; FCM device tokens are stored only on our servers and are deleted on app uninstall. We do not use analytics platforms (Google Analytics, Meta Pixel, etc.) on the marketing site.
P12. AI training
We do not train AI models on user data. The third-party AI providers we use (OpenAI, Google, ElevenLabs, FAL/Hailuo/Luma/MiniMax) operate under terms that prohibit training on our API traffic. Reference photos uploaded for personalisation are stored on our infrastructure and are sent to providers only at generation time, scoped to a single request.
P13. Data breach notification
In the event of a personal-data breach that is likely to result in a risk to your rights and freedoms, we will notify affected individuals and the appropriate supervisory authority within 72 hours of becoming aware, in accordance with GDPR Art. 33–34 and analogous regulations.
P14. Changes to this notice
Material changes will be communicated via email to the carer email on file at least 14 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision.
